Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website located at shingleroofers.co.nz ("Site") and the supply of roofing and related services ("Services") by Shingle Roofers Ltd, a company incorporated in New Zealand ("we", "us", "our").

By accessing the Site or engaging our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or engage our Services.

These Terms are governed by the laws of New Zealand and the courts of New Zealand shall have exclusive jurisdiction over any disputes.

2. Our Services

Shingle Roofers Ltd provides roofing installation, repair, replacement, painting, inspection, gutter services, asbestos removal, and asbestos encapsulation services in New Zealand. A full description of each service is available on the relevant service pages of the Site.

All Services are subject to a formal written quotation accepted by both parties. We do not commence work without a signed acceptance of our written quote. Verbal agreements do not constitute a binding contract for the supply of Services.

We reserve the right to decline to provide Services at our sole discretion, including where we determine a job presents safety risks that cannot be adequately mitigated, or where access to the property cannot be safely arranged.

3. Quotations and Pricing

All quotations are provided free of charge and without obligation. A quotation is valid for 30 days from the date of issue unless otherwise stated in the quotation document.

Quotations are based on information available at the time of the site inspection or assessment. If additional work is identified during the course of a job for example, structural damage not visible during inspection, discovery of asbestos-containing materials, or hidden rot in roof framing we will notify you promptly and provide a variation quote before proceeding with additional work.

All prices stated in quotations are inclusive of GST at the current New Zealand rate (15%) unless otherwise specified. Material prices are subject to change and are confirmed at time of order placement.

We do not engage in price matching or guarantee matching third-party quotes. Each quotation reflects our own costings, materials, and workmanship standards.

4. Payment Terms

Payment terms are stated in the individual quotation and/or invoice. Standard payment terms for residential work are:

  • A deposit (typically 20–30% of the quoted price) payable upon acceptance of the quotation to secure materials and scheduling
  • Progress payments may apply for large projects as specified in the quotation
  • Balance is due and payable within 7 days of completion of work

For commercial or developer projects, payment terms will be specified in the relevant contract documentation.

Late payments attract interest at a rate of 2.5% per month on the outstanding balance. We reserve the right to suspend work on ongoing projects where invoiced amounts become overdue.

Accepted payment methods include bank transfer (preferred), Visa, and Mastercard. A 1.5% surcharge applies to card payments.

5. Workmanship Warranty

Shingle Roofers Ltd provides a 5-year workmanship warranty on all roofing installation, replacement, and repair work. This warranty covers defects in workmanship including leaks or failures attributable to the method of installation but does not cover:

  • Damage caused by subsequent weather events, natural disasters, or acts beyond our control
  • Deterioration of materials beyond the manufacturer's stated product warranty period
  • Damage caused by third-party work carried out on or near the roof after our work is completed
  • Consequences of deferred maintenance by the property owner
  • Pre-existing defects not visible at time of inspection and not related to our scope of work

Manufacturer product warranties apply separately and are subject to each manufacturer's terms. We will assist you with warranty claims to manufacturers where defects are identified within the product warranty period.

To make a warranty claim, contact us in writing at [email protected] with a description of the defect and supporting photographs. We will inspect and assess the claim within 10 business days.

6. Limitation of Liability

To the maximum extent permitted by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, our liability for any loss or damage arising from the supply of Services or use of the Site is limited to the cost of the specific Services supplied.

We are not liable for any consequential, indirect, or special loss including but not limited to: loss of rent, loss of business, cost of alternative accommodation, or damage to internal contents caused by a roof leak, unless such loss is caused by our gross negligence or wilful misconduct.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

The Consumer Guarantees Act 1993 gives consumers certain non-excludable guarantees. Where those guarantees apply, these Terms do not seek to limit our obligations under them in consumer transactions.

7. Site Access and Property

You must ensure we have safe and unobstructed access to the roof and any areas required to carry out the work on the agreed start date and throughout the work period. This includes ensuring vehicles are moved from driveways where required, scaffolding erection areas are clear, and any security systems or gate locks are addressed.

Where we cannot access the property on the agreed date due to access issues beyond our control, a call-out fee may apply. We will contact you to reschedule at the earliest available time.

You are responsible for securing any fragile items, outdoor furniture, or vehicles that may be affected by roof debris, materials, or water during the work. We will take reasonable care but are not liable for incidental damage to property in areas we are required to work through.

8. Asbestos Services

Asbestos removal and encapsulation services are carried out strictly in accordance with the New Zealand Health and Safety at Work (Asbestos) Regulations 2016 and WorkSafe New Zealand guidelines. Our technicians hold current Class A and/or Class B asbestos removal licences as appropriate to the scope of work.

You must disclose to us any known or suspected asbestos-containing materials at the property prior to any work commencing. Failure to disclose suspected asbestos that is later disturbed during standard roofing work may result in work stoppage and additional cost for appropriate remediation, for which we cannot be held liable.

Clearance certificates are provided following all notifiable asbestos removal work as required by law.

9. Insurance

Shingle Roofers Ltd holds current public liability insurance and employers' liability insurance. Certificates of currency are available on request.

Where we are engaged to assist with insurance claim repairs, we provide damage assessments and documentation in good faith based on visible damage at the time of inspection. We make no representations regarding the outcome of any insurance claim and are not liable for any claim that is declined by your insurer.

You are responsible for maintaining adequate home and contents insurance on your property throughout any work period. We recommend you notify your insurer that roofing work is being carried out.

10. Disputes

We aim to resolve any disputes promptly and fairly. If you are dissatisfied with any aspect of our Services, please contact us in the first instance at [email protected] or call 022 196 9021.

If a dispute cannot be resolved informally, parties may refer the matter to mediation or, for amounts within its jurisdiction, the Disputes Tribunal of New Zealand. We are committed to participating in good faith in any such process.

11. Website Use

The content on this Site including text, images, photographs, graphics, and downloadable files is owned by or licensed to Shingle Roofers Ltd and protected by New Zealand and international copyright law. You may not reproduce, republish, distribute, or commercially exploit any content without our prior written consent.

You may use the Site for lawful purposes only. You must not attempt to gain unauthorised access to any part of the Site, transmit malicious code, or use the Site in a way that impairs its availability or function for other users.

We make reasonable efforts to ensure the information on this Site is accurate and up to date, but we do not warrant that it is error-free. Prices and availability of services are subject to confirmation at the time of quotation.

Links to third-party websites are provided for convenience only. We do not endorse those websites and are not responsible for their content.

12. Privacy

Collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Site or engaging our Services, you consent to the collection and use of your information as described in the Privacy Policy.

We may update these Terms from time to time. The date of the most recent update appears at the top of this page. Your continued use of the Site or engagement of our Services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. The courts of New Zealand shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Site or Services.
